Terms of Service

You must be at least 13 years old (or the minimum age required in your country) to use Nyzaverse. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or guardian. By using the Service you represent that you meet these requirements and that you can form a binding contract.

You can explore parts of the Service without an account. To unlock a saved avatar, a name and persistent presence, you can sign in (we use Google Firebase Authentication / Google Sign-In). You are responsible for activity under your account and for keeping your sign-in secure. Provide accurate information, do not impersonate anyone, do not share or transfer your account, and tell us promptly at support@nyzaverse.com if you suspect unauthorized use. You may close your account at any time.

The Service is a shared, live world. You agree to follow our Community Guidelines, which are part of these Terms, and you agree that you will not:

• Harass, threaten, bully, stalk, or harm other people, in voice, text or in-world action.
• Post or transmit hateful, violent, sexually explicit, or otherwise harmful or illegal content, or content that endangers minors.
• Use a name, avatar, or content that is obscene, hateful, deceptive, or infringes others' rights.
• Spam, scam, phish, advertise without permission, or disrupt voice/chat or events.
• Cheat, exploit bugs, use unauthorized automation or bots, or interfere with the world for others.
• Attempt to access accounts, data, or systems you are not authorized to, or probe, scan or breach security.
• Reverse engineer, scrape, overload, or copy the Service except as the law expressly permits.
• Break any applicable law or infringe anyone's intellectual-property or privacy rights.

We may remove content, and suspend or terminate access, for conduct that we reasonably believe violates these Terms or harms the community — with or without notice, and in our discretion.

Voice and text chat are heard and seen by other people near you in real time. Treat the world like a real public space: be respectful, assume others can hear you, and do not record or redistribute other people's voice, likeness, or chat without their consent. Moderators and automated systems help keep worlds safe, and you can report problems in-world or at safety@nyzaverse.com.

You keep ownership of the content you create or transmit (such as chat messages, names, and creations). To operate the Service, you grant Nyzaverse a worldwide, non-exclusive, royalty-free license to host, store, transmit, display and otherwise use that content as needed to run, secure and improve the Service and to deliver it to other participants. You are responsible for your content and confirm you have the rights to share it. This license ends when your content is removed, except where we must retain it for safety or legal reasons.

Nyzaverse, the worlds, software, 3D assets, characters, art, music, designs, logos and the "Nyzaverse" and "Nyza Creations" names are owned by Nyza Creations or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service except as expressly allowed by us or the law.

The Service relies on third parties — including Google Firebase / Google Cloud for sign-in and hosting and a real-time media provider for voice and presence. Your use of those features may also be subject to their terms. We are not responsible for third-party services we do not control. Links to other sites are provided for convenience and are not endorsements.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any content or conduct of other users will meet your expectations. Nyzaverse is an evolving product offered for free; worlds and features may change, pause, or close.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYZAVERSE AND NYZA CREATIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR THE CONDUCT OF OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (WHICH FOR A FREE SERVICE MAY BE ZERO) OR US$100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold harmless Nyzaverse and Nyza Creations from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or others' rights, to the extent permitted by law.

You may stop using the Service at any time. We may suspend or terminate your access, remove content, or restrict features if you violate these Terms or our Guidelines, if needed to protect the Service or other users, or if required by law. Sections that by their nature should survive termination — including IP, disclaimers, liability, and indemnity — will survive.

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules, and you and we agree to the exclusive jurisdiction of the state and federal courts located in Washington for any dispute that is not otherwise resolved, except where applicable law gives you the right to bring a claim in your home jurisdiction. Please contact us first — most issues can be resolved quickly and informally.

We may update these Terms as the Service evolves. When changes are material we will update the "Last updated" date and, where appropriate, notify you in-product. Your continued use after changes take effect means you accept the updated Terms.
